The following terms and conditions (hereinafter “General Conditions”) apply to Customer’s access and use of the URL www.culturesardinia.com (hereinafter “Website”) owned by Culture Sardinia di Alessandro Picciau (hereinafter “Culture Sardinia”) and the services offered therein (hereinafter “Services”).
The Customer is a natural person, who declares to be of legal age and, therefore, to have the legal capacity to purchase the services offered through the Website and to use it in accordance with the General Conditions (hereinafter “Customer”).
The Customer also declares that all the information provided during the registration to the Website and during its use is true, complete, accurate and up to date, assuming all responsibility in the event that this is not the case.
To this end, the Customer undertakes to promptly notify Culture Sardinia of any changes to their registration data.
The conditions herein apply to all bookings and purchases of services marketed by Culture Sardinia on the website www.culturesardinia.com. In order to purchase the services sold on www.culturesardinia.com it is necessary to accept the following Terms and Conditions.
Customer: indicates the final purchaser.
Service(s): indicates the travel services, such as but not limited to, tours, guided tours, excursions and other tourist services which can be booked and purchased on the Website.
Website: indicates www.culturesardinia.com.
Culture Sardinia: means Culture Sardinia by Alessandro Picciau with registered office in Dolianova (CA), Via Olbia 20/A (Italy), Tax Code PCCLSN79P24B354E and VAT number 03507400921.
Supplier(s): means the supplier(s) of the tourist services making up the Service.
Voucher: indicates the document issued proving the purchase and payment of the Service(s).
Meeting Point: indicates the meeting place from which the guided tour or the Service purchased starts.
Culture Sardinia undertakes to treat the Customer’s data in accordance with Legislative Decree no. 196/2003 (Privacy Code) and any other applicable legislation. The data provided will be used exclusively for communications relating to the activities of the Website, in full protection of the rights and confidentiality of those concerned, excluding the transfer to third parties. The data relating to credit card payment will be stored and managed by the competent banking institutions which will process them according to criteria of security and confidentiality.
The following conditions are governed by Italian law. The Court of Cagliari, Italy, shall have exclusive jurisdiction and competence for any disputes relating to these conditions. Nevertheless, Culture Sardinia reserves the right, if it deems it necessary, to take legal action before the courts of countries or cities other than Italy or Cagliari to protect its interests and enforce its rights.
Bookings pending confirmation:
Cancellations of bookings pending confirmation are not subject to any penalty.
Cancellation of bookings before payment:
Bookings cancelled before payment are not subject to any penalty.
Cancellation of bookings after payment:
Any refund of the booking can only be made to the credit card used for payment. Refunds will be made in the currency in which the booking was paid (€).
The above cancellation policy applies to all bookings relating to “Tours & Activities and Related Services” made on the Website unless otherwise specified, excluded special non-refundable rates or during high season, special events or showcases. Culture Sardinia, holder of all the rights on the Website it has designed and created, is not responsible in the event of misunderstandings, inconveniences or other failures of any kind on the part of the Service(s) Supplier(s) and/or on the part of the Suppliers of the individual tourist services constituting the Service itself. For this reason, the information contained in the descriptions may vary and Culture Sardinia does not guarantee, beyond a reasonable verification, the correctness and/or accuracy. Culture Sardinia will do its best to promptly update the information contained in the Website. In no case Culture Sardinia will be liable for breach of contract by the Supplier(s) of Service(s), or for damages, costs, losses of any kind suffered by the Customer and/or third parties resulting from acts and/or omissions of the Supplier(s) of Service(s).
Under no circumstances Culture Sardinia will be liable for delays and/or failure to perform its obligations due to cases of force majeure, meaning by this any act, fact and/or circumstance beyond its reasonable control. In exceptional cases and/or for reasons of force majeure that do not allow the full use of the Service(s) already purchased, Culture Sardinia reserves the right to cancel it. By way of example, the following are to be considered exceptional cases and cases of force majeure which do not allow the full use of the Service(s) purchased: natural events (such as disasters, bad weather, floods), strikes, exceptional closures, serious unforeseen events or health problems of those involved in providing the service as a result of which it is not possible to find substitutes, opening of hostilities, riots, acts of terrorism, revolution, acts of any governmental authority (such as withdrawal of licenses or authorizations), fires, epidemics, explosions, interruption of a utility service (such as gas, electricity, water, telephone), renovations, lockouts or boycotts, embargoes, siege. In case of cancellation of a Service already purchased, Culture Sardinia will promptly refund the entire price paid for it.
Requests for withdrawal received after the time limit set out in the Cancellation Policy above, will be assessed at Culture Sardinia’s sole discretion. No refund will be made in case of no show (no attendance at the time and Meeting Point indicated in the Voucher).
The Customer should address any complaints about the Service booked, where possible, directly to the Supplier of the Service. If the Supplier is not able to solve the problem adequately, the Customer must inform Culture Sardinia by email as soon as possible and in any case within 20 days from the date of Service. Complaints sent later than 20 days from Service will not be taken into consideration.
Culture Sardinia will send an acknowledgement of receipt of the message. A conclusive response to the complaint, and to any request for refund, will be sent after having listened to the parties involved (Customer and Supplier) and ascertained how the facts were conducted.
Service Information:
The Customer may book and purchase or request the booking of Service(s) for individual and/or group tours.
Services on direct sale:
Booking of Services on direct sale is considered confirmed at the end of the credit card payment process. Booking of Services is subject to availability. In order to use the purchased Service, it is necessary to give the Supplier the purchase confirmation containing the reservation number (Voucher). The Voucher is the only recognized document and can be submitted in electronic or paper format depending on what is indicated on it.
Services on request:
In order to allow an adequate organization, the purchase of Services on request (e.g.: private tours or not for direct sale, private transfers, and so on) must be made at least 72 working hours before the date of use of the Service. Culture Sardinia will communicate the acceptance of the booking by sending an email confirmation inviting the Customer to process the payment by credit card through a procedure protected by a secure line (SSL).
Booking of Services on request will be considered confirmed at the end of the credit card payment process.
In the event of non-payment within the indicated terms (at least 72 working hours before the date of use of the Service), the booking will be automatically cancelled.
The booking of the Services is subject to availability. In order to use the purchased Service, it is necessary to give the Supplier the purchase confirmation containing the reservation number (Voucher). The Voucher is the only recognized document and can be submitted in electronic or paper format depending on what is indicated on it.
Service changes:
If, after purchase, the Customer wishes to make changes to the Service(s), they may contact customer support using the ‘Contact Us’ form on the Website. Culture Sardinia will make all reasonable efforts to respond to the Customer’s requests for changes but cannot guarantee that such changes will be made.
Special Offers and Restrictions:
Special offers are subject to availability. Any restrictions are set out in detail in the offer on the Website.
Voucher
It is mandatory to show up at the Meeting Point with the Voucher proving the purchase of Service(s). The Voucher is the only recognized document and can be submitted in electronic or paper format depending on what is indicated on it. The Voucher must be given to the Supplier present at the Meeting Point. If the Voucher is not provided, the Supplier of the Service may not accept the booking and may ask for payment again. The Voucher indicates the reservation number assigned at the time of booking, the name of the person responsible for payment (Customer) and the specifications of the Service purchased, such as date, time, Meeting Point, number of participants.
The Website is solely and exclusively for the Customer’s personal use and may not be used for illegal purposes. In particular, the Customer may not resell to third parties the Services purchased through the Website. Registration is needed in order to use the services offered on the Website, and in particular to submit purchase orders.
The use of the Website by the Customer implies the express, full and unreserved acceptance of the General Conditions, in particular those concerning the limitation of liability of Culture Sardinia and the Suppliers of tourist services or travelling.
Before using the Website, the Customer is therefore required to carefully read the General Conditions on each occasion on which they intend to use it, since they may have been modified since their last access.
In the event of non-compliance with the General Conditions, Culture Sardinia reserves the right to deny or limit access to the Website and/or the services provided therein to the offending Customer at any time and without prior notice.
Whenever a request to purchase a Service is sent to Culture Sardinia, the Customer will receive an email confirming receipt of the request. It is understood that neither this request nor the subsequent confirmation email will complete the purchase of the chosen service. Once the purchase request has been received, Culture Sardinia will verify its regularity.
Only in the event that such verification is successful and provided that there is availability, Culture Sardinia will send the Customer a communication of confirmation and acceptance of the purchase request.
The purchase of any Service will be completed only when Culture Sardinia validly charges the credit card or debit card indicated by the Customer or receives, with other systems, the payment amount. It is understood that, until then, the booking may be cancelled or refused by Culture Sardinia if it is found that the Customer does not meet the requirements for access to the Service.
Culture Sardinia declines, as of now, any liability for any abusive or improper use of the Customer’s credit card and/or for any harmful consequence that may arise to the Customer for transactions carried out by credit card, which implies operations outside its sphere of control.
In the event that any supplements, indicated in the Service description on the Website, are not reflected in the breakdown of the total price at the time of completion of the booking request, these supplements will still be charged to the Customer during the completion of the booking.
It should be noted that the provision of Data for these purposes is mandatory and any refusal will make it impossible to establish business contacts. The processing of Data does not require the consent of the person concerned.
The Customer authorizes Culture Sardinia to use the Data for presentation and administration of services and communications through different channels: email, telephone or mobile systems in their different options.
The Website and all its contents (such as, for example, texts, images, brands, graphics, logos, buttons, software files, colour combinations, as well as the structure, selection, order and presentation of the contents) are the exclusive property of Culture Sardinia and their distribution, public communication and transformation is prohibited.
It is also prohibited to reproduce, retransmit, copy, transfer or broadcast, in whole or in part, the information contained therein, whatever the purpose and means used.
The Customer undertakes to use the Website only and exclusively for private and personal use. They may not copy, reproduce, transmit or distribute in any way the content of the Website or the Services that may be obtained through it, without the prior written permission of Culture Sardinia.
The Customer may not create links to the Website without the prior written consent of Culture Sardinia.
The Customer is responsible for being in possession of a valid identity document (identity card or passport in addition to any visa, if required) as well as having completed all formalities required for travelling (such as, for example, vaccination or other medical certificate), either relating to a tourist package, or to individual travel services.
In this regard, please note that the necessary information is available on the website of the Ministry of Foreign Affairs (www.viaggiaresicuri.it) and at the authorities of the countries of destination. The Customer is required to inform the competent authorities of the countries of destination about any special procedures relating to the journey.
Culture Sardinia may indicate and request additional specific information/conditions within the Website.
The Website is provided by Culture Sardinia “as is”; therefore, Culture Sardinia is not responsible, directly or indirectly, for:
Culture Sardinia is exonerated, to the extent consistent with the provisions of the Tourism Code, from liability not attributable to it arising from the failure or partial fulfillment of obligations assumed by third party Suppliers of Services in accordance with current legislation and with the terms and conditions of sale provided for each Service purchased through the Website.
Culture Sardinia is not liable for damages resulting from cancellations or changes to the Service(s) due to force majeure or unforeseeable circumstances (such as, but not limited to, strikes, fires, natural disasters, wars and terrorist attacks).
The Website contains links to other websites over which Culture Sardinia has no control and for which it is not responsible. These links are made for the sole purpose of assisting the Customer in searching for information and resources and their publication does not imply any control, evaluation or approval of the content and information by Culture Sardinia.
Therefore, Culture Sardinia is not responsible for the reliability, truthfulness, accuracy and updating of the contents and information on these sites.
The Customer acknowledges that the use of such sites falls exclusively under their own exclusive domain and under their own sole responsibility.
Culture Sardinia may use a text message service to confirm or send the Customer notifications related to the Service(s) purchased.
This service is provided for transmission only and not for reception. Therefore, if the Customer wishes to contact the operators of Culture Sardinia, they will need to use the telephone number or email address indicated in the “Contact Us” section of the Website.
Culture Sardinia reserves the right to modify or update the General Conditions.
Such modifications/updates will be communicated to the Customers at least 15 days before their enactment. At the sole discretion of Culture Sardinia, the notice will be made either through a pop-up window which will open when accessing the page, or through a direct communication to the Customer.
Continued use of the Website after such changes/updates become effective is to be considered an acceptance thereof.
